A German court has ruled that a man who slipped and got injured while walking from his bed to his home office can claim workplace accident insurance because he was technically commuting.
The unnamed man reportedly slipped and broke his back on the spiral staircase connecting the rooms before eating his breakfast.
Because the man has not gotten breakfast yet, statutory accident insurance was valid because it was his “first” journey to work and was considered a commute.
The claim was denied by the employer’s insurance but was overruled by the court.
“The first-morning journey from bed to the home office [was] an insured work route. If the insured activity is carried out in the insured person’s household or at another location, insurance cover is provided to the same extent as when the activity is carried out at the company premises,” said the court.
