Report: Leaked Supreme Court Draft Opinion Suggests Majority Set to Overturn Roe v. Wade Decision

A leaked United States Supreme Court draft opinion has suggested that the majority of the court is poised to overturn the landmark Roe v. Wade decision that established a constitutional right to abortion, Politico reported.

“Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division,” Justice Samuel Alito wrote in the 98-page draft obtained by Politico.

Citing a “person familiar with the deliberations,” Politico reported that four of the other Republican-appointed justices — Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett — had voted with Alito in their private conference after oral arguments in December.

The draft circulated inside the court in early February, according to Politico.

If the draft is adopted, the Court would uphold a Mississippi law that would ban abortion after 15 weeks of pregnancy.

The disclosure of the opinion is a rare breach of Supreme Court confidentiality around its deliberations, raising questions about its ability to keep deliberations secret.

The Court has yet to release its final opinion, which is expected at the end of its term in late June.

Votes can change before opinions are formally released.

In response to the leak, Planned Parenthood called the draft “outrageous” and “unprecedented.”

“While abortion is still legal, tonight’s report makes clear that our deepest fears are coming true. We have reached a crisis moment for abortion access. We don’t have a moment to spare — we must act now,” the organization said on Twitter.
