Amazon Accuses Influencers Of Peddling Counterfeit Goods

Amazon has filed a lawsuit against Instagram and TikTok influencers for allegedly promoting and conspiring in a scheme to sell counterfeit luxury products on the e-commerce giant’s platform.

Amazon filed the lawsuit in the US District Court for the Western District of Washington on Thursday, accusing Kelly Fitzpatrick and Sabrina Kelly-Krejci of using the social media platforms of Instagram, Facebook and TikTok, as well as their personal websites, to lure individuals into buying the fake products.

According to the e-commerce giant, the two influencers worked with 11 individuals or businesses to ran the scam of selling “dupes” – products that have been made to look similar to the original items without infringing on trademarks or copyrights.

However, the company found out that the luxury goods were actually knockoff merchandises sold by the platform’s independent sellers who obscured them in the marketplace’s product listings.

 “Amazon strictly prohibits counterfeit products in its stores, and in 2019 alone, invested more than $500 million to protect customers and brands from fraud, abuse, and counterfeit,” Amazon said in a statement.

Fitzpatrick and Kelly-Krejci were previous members of the influencer marketing program of Amazon. However, they were evicted from the initiative after getting exposed of promoting counterfeit products sold on the online marketplace.

The two social media influencers declined to comment on the lawsuit.

”These defendants were brazen about promoting counterfeits on social media and undermined the work of legitimate influencers,” said Cristina Posa, associate general counsel and director of Amazon’s anti-counterfeit task force.
